The qur’an & hadeeth explicitly give directives about the presence of the guardian, his consent and permission at the time of marriage. Where ever injunctions regarding women's marriage are recorded in the holy qur’an, they address not the marrying woman but their guardians. For instance, divine order: "do not marry unbelieving woman until they believe".œ it clearly states that women are not permitted to get themselves married. On the other hand their guardians are being directed not to marry their women with polytheists. Regarding guardian's consent and permission, the holy prophet's () some sayings may be noted, "without wali's (guardian's) presence (permission) there is no wedlock" (abu dawood, tirmidhi, ibn-e-maja).
